BabyByYou!™ is thrilled to
offer commercial sewing licenses for our patterns, however if you are
interested in using any of the BabyByYou! Patterns for profit and
home business purposes, you must do so in accordance to the following
terms and conditions.
Typically, when you purchase a BabyByYou!™ pattern, it is
licensed for personal and home use only. This means that if you
purchase a pattern you may make the end product in any quantity, as
long as you do not charge for it.
Cottage Industry:
If you are working out of your home you may purchase a "Cottage
Industry License" which will give you the right to use
BabyByYou! Pattern in your for-profit-home-business.
12 consecutive years of renewing annual license (13 years total)
will automatically transfer into lifetime
status, and a new framable license will be issued via US Mail.
With payment of any licensing fee, you will receive a free membership
to our private mailing group for contractors, which is used to keep you updated about new patterns,
as well as any other important announcements. However absolutely
NO assistance aside from standards and relevant license information is provided
by BabyByYou!™.
We do provide quality-control seals in web-graphic format to
ensure the appearance of your items meets our approval, in order to
protect our trademarks. These are provided free of charge,
however you must submit one appropriately sewn item
to be evaluated.
To qualify for one of BabyByYou!™'s cottage industry
licenses, you must do the sewing yourself with absolutely no
additional help.
These low cost licenses (especially "QUICK START" licenses) are designed
predominantly to help mothers sew for profit while staying home to care for their children
and/or running their own home business. This is not
a license for any type of commercial or factory setting production.
The licenses are only valid for BabyByYou!™ authorized patterns, including,
but not limited to:
- CuddleBuns™ Diaper Pattern
- HoneyBoys™/HB-Home™ Fleece AIO Diaper Pattern
- Poochies™ Patterns
- SnuggleBees™ Patterns
You must purchase a license for each pattern you wish to use commercially,
however you may purchase a second license for a second pattern line
with current discounts.
Commercial Production:
At this time we are not granting anyone permission
to use our patterns in any type of commercial production. This includes any type
of factory situation or a situation where you are hiring or contracting other
people to work for you, even in your own home.
This includes contract help who are not in your direct employ, but may be doing
work for you. We reserve the rights to change the above regulations at any time.
The cost of developing new designs, as well as publishing and marketing them,
is immense and the contract licensing fees help with this cost.
Like many other industries, every time a pattern is copied, sold, or distributed
illegally -- we will lose a much needed sale. If one were to hire a pattern designer to
create new patterns for them exclusively, it would cost hundreds or even thousands of dollars.
The only way for BabyByYou!™ to thrive and expand is by the sale of patterns and
or licensing fees.
Please note: All cottage industry license fees go towards the
for-profit use of the pattern ONLY. Licenses are sold with absolutely
no guarantee or promise of success or any specific monetary gain.
While BabyByYou!™ does plan to
continue licensing indefinitely, renewals cannot be guaranteed.
Contract License Fees are absolutely non-transferable and non-refundable.
